These Terms and Conditions (“Terms”) govern purchases made through the AMG Collectibles website and your use of our online store. By placing an order through our website, you agree to these Terms as well as our Privacy Policy and any other policies referenced during checkout.
Please review these Terms before completing a purchase.
1. About AMG Collectibles
AMG Collectibles (“AMG,” “we,” “us,” or “our”) operates a collectibles retail business in Bedford, Nova Scotia, Canada.
Our online store may offer sports cards, trading cards, collectibles, memorabilia, hobby supplies and other related products. Some products may be publicly available through our online store, while others may be made available through a direct product link created for a particular customer or transaction.
2. Product Availability and One-of-a-Kind Items
Many collectibles offered by AMG are unique, limited in quantity, or available as a single item.
Unless otherwise stated, availability is not guaranteed until an order has been successfully submitted and accepted by AMG.
Although our inventory systems are designed to prevent an unavailable item from being purchased, inventory discrepancies can occur. For example, an item may have been sold in-store, through another sales channel, or to another customer before the website inventory has been updated.
If an ordered product is unavailable, AMG may cancel the affected item or order and refund any amount already paid for that unavailable product.
A customer’s submission of an order does not require AMG to complete a transaction where the product is unavailable, an obvious pricing or listing error has occurred, payment cannot be verified, fraud is reasonably suspected, or fulfillment is otherwise not reasonably possible.
3. Product Images, Descriptions and Condition
We make reasonable efforts to accurately describe and photograph products offered through our website.
Collectibles may have variations, imperfections, manufacturing defects, wear, print defects or other characteristics associated with their age, production, storage or previous ownership.
Where photographs show the actual item being sold, customers are encouraged to review those photographs carefully before purchasing.
Computer screens, mobile devices, lighting and photography may cause colours or other visual characteristics to appear somewhat different from the physical item.
Any condition description, grade estimate or opinion provided by AMG for an item that has not been professionally graded is an opinion only and is not a guarantee that a professional grading company will assign the same condition or grade.
Where a collectible has been professionally graded, any grade displayed is the grade assigned by the identified third-party grading company. AMG does not control or guarantee the grading standards, decisions or opinions of third-party grading companies.
4. Pricing
Prices displayed on the AMG website are shown in Canadian dollars unless otherwise stated.
Where a product is specifically advertised as having an all-in price, the displayed price represents the final amount charged by AMG for that product and includes applicable sales taxes and tracked shipping to eligible destinations, unless the product listing or checkout expressly states otherwise.
AMG reserves the right to correct genuine typographical, technical or pricing errors.
If an obvious pricing error materially affects an order, we may contact the customer before fulfillment or cancel the affected transaction and issue a refund of any amount paid.
5. Payment
Payment must be completed using a payment method offered during checkout.
Credit Card
Credit-card transactions are processed through Clover or associated payment-processing services.
A customer’s order may be subject to authorization or verification by the payment processor. AMG does not guarantee that a payment method will be authorized.
AMG does not receive or store complete credit-card credentials through our website.
Interac e-Transfer
Customers selecting Interac e-Transfer must send payment using the instructions provided during checkout or in the order confirmation.
An Interac e-Transfer order is not considered paid until AMG has actually received and verified the payment.
Customers should include the requested order information with their transfer so that the payment can be properly identified.
Orders awaiting e-Transfer payment may be held temporarily. AMG reserves the right to cancel an unpaid order where payment is not received within a reasonable period.
6. Order Acceptance
An automated order confirmation acknowledges that AMG has received your order. It does not necessarily constitute final acceptance of the transaction.
AMG may review an order before fulfillment.
We reserve the right, acting reasonably, to refuse or cancel an order where:
- an item is unavailable;
- payment has not been received or authorized;
- the order contains an obvious pricing or listing error;
- shipping or fulfillment information is incomplete or invalid;
- we reasonably suspect fraud, unauthorized payment or misuse of the website; or
- fulfillment would violate applicable law or otherwise cannot reasonably be completed.
If AMG cancels an order after receiving payment, the amount paid for the cancelled order or item will be refunded.
7. Direct Customer Purchase Links
AMG may create a private or direct product link for a product being offered to a particular customer.
A direct link does not guarantee continued availability of the product unless expressly stated by AMG.
Unless otherwise agreed, the product remains subject to these Terms and is considered purchased only after the customer successfully completes checkout and any required payment is received or authorized.
Customers should not assume that possession of a product link indefinitely reserves the item.
8. Shipping
Unless otherwise stated, products purchased through the AMG online store are shipped using a tracked shipping service.
Customers are responsible for providing a complete and accurate shipping address during checkout.
AMG will ship an order to the address supplied by the customer. Customers should carefully verify their address before submitting an order.
If a customer discovers an address error before shipment, they should contact AMG immediately. We cannot guarantee that an address can be changed once an order has been processed or shipped.
Once an order has been shipped, the customer will normally receive tracking information by email.
Estimated delivery times are estimates only. Actual delivery times are controlled by the postal or courier service and may be affected by weather, service interruptions, customs processing, peak shipping periods and other circumstances outside AMG’s reasonable control.
AMG is not responsible for delays caused solely by a postal or courier service after a properly addressed shipment has been transferred to the carrier, but we will reasonably assist customers in investigating legitimate delivery issues.
9. International Orders, Customs and Import Charges
For orders shipped outside Canada, customs authorities in the destination country may assess duties, taxes, brokerage fees, import charges or other government-imposed amounts.
Unless AMG expressly states otherwise, such charges are not charges imposed or collected by AMG and remain the responsibility of the recipient.
Customs rules and assessments are determined by the applicable government or customs authority and are outside AMG’s control.
Customers are responsible for ensuring that products they purchase may lawfully be imported into their destination country.
10. Returns, Refunds and Order Issues
Returns, refunds, cancellations and exchanges are governed by AMG’s Refund and Returns Policy, as applicable to the particular purchase.
Customers should inspect their order after delivery and contact AMG promptly if they believe an incorrect product was received or an item was materially damaged during shipment.
Customers should retain the product, original packaging and shipping materials while a damage or delivery claim is being reviewed and may be asked to provide photographs or other reasonable information necessary to investigate the issue.
Nothing in these Terms is intended to exclude rights or remedies that cannot legally be excluded under applicable consumer protection law.
11. Chargebacks and Payment Disputes
Customers who believe there is a legitimate problem with an order are encouraged to contact AMG so that we have an opportunity to investigate and resolve the issue.
Nothing in these Terms prevents a customer from exercising legitimate rights available through their card issuer, financial institution or applicable law.
However, customers must not knowingly initiate a fraudulent or misleading payment dispute, falsely claim that an authorized transaction was unauthorized, or misrepresent the receipt or condition of an order.
AMG may provide order records, payment records, tracking information, correspondence and other relevant transaction information to a payment processor or financial institution when reasonably necessary to respond to a payment dispute.
12. Website and Listing Errors
We make reasonable efforts to ensure that information on our website is accurate and current. However, typographical errors, technical errors, incorrect photographs, inaccurate descriptions, inventory discrepancies or other unintended errors may occasionally occur.
AMG may correct errors or update information when discovered.
We may cancel and refund an affected transaction where a material error makes fulfillment unreasonable or where enforcing an obvious error would produce an unintended transaction.
13. Third-Party Services
Our website and order process rely on third-party services, which may include website hosting, WooCommerce, payment processing, email services, postal and courier services and other technology providers.
Temporary outages or failures of third-party systems may occasionally affect website availability, payment processing, order notifications or other functionality.
AMG is not responsible for independent third-party services outside our reasonable control, although we will make reasonable efforts to address problems affecting an AMG transaction.
14. Intellectual Property
Unless otherwise indicated, AMG’s website design, AMG-created graphics, logos, written content and other original materials displayed on the website are owned by or licensed to AMG Collectibles and may not be reproduced or commercially used without permission.
Product names, manufacturer names, league names, team names, character names, trademarks and other third-party intellectual property remain the property of their respective owners.
The sale or display of a collectible containing third-party intellectual property does not imply that AMG owns that intellectual property or is affiliated with the applicable rights holder unless expressly stated.
15. Prohibited Use
Customers may not use our website:
- for unlawful or fraudulent purposes;
- to interfere with the operation or security of the website;
- to attempt unauthorized access to accounts, systems or information;
- to submit false or misleading transaction information;
- to engage in fraudulent payment activity; or
- to use automated systems in a manner that unreasonably interferes with the availability or operation of the website.
16. Limitation of Liability
To the extent permitted by applicable law, AMG Collectibles will not be liable for indirect, incidental, special or consequential losses arising from the use of our website or the purchase of products through it.
Where AMG is legally liable in connection with an online purchase, AMG’s liability will, to the extent permitted by law, be limited to the amount paid for the product or order giving rise to the claim.
These limitations do not apply where liability cannot lawfully be excluded or limited.
17. No Waiver of Consumer Rights
These Terms are intended to establish reasonable rules governing transactions with AMG and are not intended to eliminate or restrict any statutory rights that a consumer is entitled to under applicable Canadian or Nova Scotia law.
If any provision of these Terms conflicts with a legal right that cannot be waived, the applicable law will prevail.
18. Governing Law
These Terms and purchases made through the AMG Collectibles website are governed by the laws of the Province of Nova Scotia and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Subject to any rights a consumer may have under applicable law, disputes relating to these Terms or an AMG online transaction will be subject to the jurisdiction of the courts of Nova Scotia, Canada.
19. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
20. Changes to These Terms
AMG may update these Terms from time to time to reflect changes to our business, website, payment methods, fulfillment practices or legal requirements.
The Terms applicable to an order are generally those in effect when the customer places the order.
The current version will be posted on our website with its applicable “Last Updated” date.
